As the State of Illinois grapples with the tort reform movement, some of the arguments for and against legislated “caps” on damages in medical malpractice cases are receiving a new airing .  At issue is whether it is fair to impose caps on non-economic damages, such as pain and suffering, despite the absence of caps on economic damages, such as future lost earnings.
